BY SIGNING OR CLICKING “I AGREE” OR CHECKING THE “AGREE TO TERMS” BOX OR BY USING THE SERVICE, YOU ARE ACCEPTING AND AGREEING TO BE BOUND BY ALL THE TERMS OF THIS CONSENT FORM. IF YOU DO NOT AGREE TO THIS CONSENT FORM DO NOT INSTALL OR USE THE SERVICE IN ANY MANNER WHATSOEVER.
1. Prior to providing you with the Service, it is important for us to verify your prior consent to the use of the information and data about you that was provided or received by us, including but not limited to Personal Information (as defined below) (the “Information”) through the Dario application (the “Application”). As part of the Service and in accordance with our privacy policy https://mydario.com/privacy-policy/, we may use the Information to provide you with 1) digital notification including, but not limited to, push notifications, SMS, emails, alerts, and so on (for example, for the purpose of sending you verification code to confirm user login, tracking info on this shipping package, and link to download the application or for marketing purposes); and 2) individual over the phone recommendations. Standard text message rates may apply. You hereby consent and authorize us to contact you in accordance with the above.
2. In order to provide you with the Services, we may transfer or permit third party’s to access your Information. You hereby consent and authorize our transfer or grant of such access in order to provide you the Service.
3. You warrant that the Information or any part thereof, is not false, fraudulent, unlawful, illegal or harmful or otherwise infringes any third party rights. You shall have the sole responsibility for the legitimacy, accuracy and legality of any Information you submit to us. You acknowledge that the Information is complete and accurate and represents your use of our Application.

You hereby acknowledge that use of the Services may include the use of certain individually identifiable information relating to you (“Personal Information”), such as your personal name, clinical history and daily habits. You agree that such Personal Information may be used, processed and transferred by us for the purpose of providing the Service. We shall not be responsible for any processing of Personal Information submitted or requested via the Application.
5. You shall have the right to withdraw your consent at any time to receive the Service, by informing us directly to (support@mydario.com) (“Notice”). We shall use commercially reasonable measures to cease using your Information and providing you with the Service within 30 days from receiving such Notice. The withdrawal of your consent shall not affect the validity of your consent prior to its withdrawal.

You hereby release us and our affiliates from any and all claims and demands arising out of the use, access, or transfer of your Information in connection with the Services, including, without limitation, any and all claims with respect to any privacy, publicity, intellectual property or similar right.
7. You hereby undertake and warrant that: (i) you have read this Consent Form and fully understand its provisions; (ii) you are least 18 years old; and (iii) you are free to enter into this Consent Form.
