• #Dario #Diabetes #InRange (the “Promotion”) is organized by DarioHealth Corp. (“we” or “us” or “our”) and is open to legal residents in the United States and are over the age of 18. By entering the competition, all entrants confirm that they have read, accepted and agreed to be bound by these Terms and Conditions.
• To get a raffle ticket entry, share the embedded Facebook posts on this page from Wednesday, February 1, 2017 at 12:01 AM EST until Tuesday, February 28, 2017 at 11:59 PM EST (“Promotion Period”). Notwithstanding the aforementioned, we may conclude this promotion before the end of the Promotion Period or may prolong the period of the promotion in our sole discretion.
• You can receive up to (4) four raffle tickets if you share each article that appears on this promotion page once. A new article to share will appear on this page on February 1st, 8th, 15th, and 22nd.
• Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, or by multiple Facebook accounts, that person’s entries will be disqualified and any prize award will be void.
• Numerous factors outside of our control may interfere with the operation of Facebook. We do not therefore guarantee continuous, uninterrupted or secure access to Facebook.
• Incomplete, illegible, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery. We take no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
• Any posts which are deemed by us as: (i) disrespectful; (ii) containing anything which is likely to, or could cause offend; (iii) unlawful or illegal; or (iv) infringes any third party rights, will be voided and will not be eligible to receive a raffle ticket.
• DarioHealth will randomly select sixteen (16) winners on March 1, 2017.
• Winners will be contacted via Facebook messenger and will have up to one (1) week to respond.
• Winners will forfeit their prize if they (i) do not respond in time; (ii) do not provide the correct details; or (iii) who make an entry on someone else’s behalf.
• Prizes mentioned above and will be sent to winners free of charge.
• In the event, not enough total entries are submitted, DarioHealth will first give away the Dario Premium Kit first, then the Dario Starter Kit, and finally the 100 Test Strips. For example, if only fifteen (15) entries are submitted, Dario will randomly select a winner for the Dario Premium Kit, then the Dario Starter Kit, and the remaining nine (9) would win 100 Test Strips.
• Odds of winning are dependent on the number of eligible entries received.
• A maximum of (1) one prize may be won per household.
• You hereby acknowledge that any material submitted to DarioHealth’s Facebook page will be by your free will and waive any claim with respect to consideration and hereby provide us the right and license to display such material on DarioHealth’s Facebook page.
• By participating, you confirm and waive any suits or claims against DarioHealth, in any matter relating to or arising from the Promotion and hereby agree that you take part in the prize at your own risk and to the fullest extent allowed by law; We accept no liability with regard to such prizes whatsoever.
• You further acknowledge that Company’s use of the foregoing material shall be for any purposes and may be distributed and published internationally.
• No cash alternative to the prize will be offered. The prize is not transferable and subject to availability. We reserve the right to cancel this Promotion at any time without giving notice.

General

• The winner agrees to participate in related publicity accompanying or resulting from the promotion without further recompense. This may include but is not limited to photographs or videos taken which may be used for publicity purposes. By entering this promotion, the winner grants the us the absolute and irrevocable right and permission to use, publish, publicly display, perform, transmit, exhibit and reproduce their name (full first name and last name initial, e.g., John D.), statements, video, voice, recordings, interviews, photographs or other visual or audible representations or likeness, in whole or in part, individually or in conjunction with other material, including without limitation, text, photographs or images in any medium (whether now known or hereafter invented) including, but not limited to the internet and other electronic and social media and for any and all purposes, publicity, promotion, packaging and trade throughout the world without restriction as to manner, frequency or duration of use or any other purpose whatsoever in connection with this promotion or in connection with the marketing of our products. The winner agrees that all materials produced pursuant to the rights set out above shall and will remain our property.
• To the fullest extent possible in law, neither DarioHealth Corp. nor any of its affiliates will be liable for any loss or damage whatsoever caused by matters relating to this promotion.
• We reserve the right to verify all entries and the winner and to refuse to award the prize or withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
• We reserve the right to vary these Terms and Conditions or cancel the promotion at any stage in the event of circumstances arising beyond its control.
• This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By entering the promotion, all participants accept that they have no claim against Facebook whatsoever. By entering the promotion via Facebook all participants agree to a complete liability release for Facebook.
• Any question concerning the legal interpretation of the rules will be based on the laws of the Commonwealth of Massachusetts and the Courts of Massachusetts will have exclusive jurisdiction.
• Your personal data is not shared with third parties. By participating in the Promotion, you agree to the use of your personal data for the purpose of participating in the promotion, identifying and contacting the winner or as otherwise described herein. You can withdraw your consent at any time, but will no longer be able to participate.
